These Terms of Use ("Terms") govern your access to and use of waveyhq.dev (the “Site”), operated by the Wavey project team ("Wavey", “we”, “us”, or “our”).
Please read these Terms carefully. By accessing or using the Site, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the Site.
1. Scope
The Site publishes documentation, technical articles, project information, public discovery metadata, and links relating to Wavey, an open-source WiFi Channel State Information (“CSI”) sensing project.
These Terms apply only to the public Site. They do not govern:
- the Wavey Console at console.waveyhq.dev ;
- software, firmware, models, APIs, or other materials governed by a separate agreement or license;
- a Wavey deployment operated by another person or organization; or
- third-party websites, repositories, communities, products, or services.
Separate terms may apply to those offerings.
2. Eligibility and authority
You may use the Site only if you can legally agree to these Terms. If you use the Site for an organization, you represent that you have authority to bind that organization, and “you” includes that organization. A minor may use the Site only with the involvement and permission of a parent or legal guardian.
3. Permitted use
Subject to these Terms, you may access and use the Site for lawful informational, educational, research, evaluation, and project-participation purposes.
The Site includes public resources intended to support search engines and automated agents. Automated access must respect published technical controls and must not impose an unreasonable load, circumvent safeguards, or interfere with availability.
4. Prohibited conduct
You must not:
- use the Site in violation of law or another person’s rights;
- attempt to gain unauthorized access to any account, system, network, endpoint, key, or data;
- probe, scan, or test vulnerabilities without prior written authorization;
- disrupt, overload, damage, or impair the Site or another user’s access;
- introduce malware, malicious code, deceptive content, or unsolicited communications;
- bypass access controls, rate limits, security headers, or other protective measures;
- scrape or harvest personal information;
- impersonate Wavey, a maintainer, or another person, or misrepresent affiliation or endorsement;
- remove proprietary notices or falsely claim ownership of Site content; or
- use the Site to facilitate unlawful surveillance, discrimination, harassment, or physical harm.
Good-faith security research must follow the security policy published with the project and applicable law.
5. Responsible use of sensing technology
WiFi sensing can infer occupancy, motion, presence, or activity without requiring a person to carry a device or actively participate. That capability creates legal, ethical, safety, and privacy responsibilities.
If you build, test, or deploy technology described on the Site, you are solely responsible for:
- obtaining all permissions, notices, and consents required from property owners, occupants, employees, residents, participants, or others affected;
- complying with privacy, surveillance, employment, housing, healthcare, consumer-protection, telecommunications, radio, export-control, and other applicable laws;
- conducting appropriate safety, security, bias, accuracy, and privacy assessments;
- securing devices, networks, credentials, telemetry, and retained data;
- establishing suitable retention, access, deletion, and incident-response practices; and
- avoiding uses that are covert, discriminatory, deceptive, unsafe, or likely to cause harm.
Do not rely on Wavey as the sole basis for medical care, emergency response, life safety, security, access control, or another safety-critical decision. Statements about privacy, accuracy, range, through-wall sensing, identity, or deployment suitability are contextual and are not guarantees.
6. Open-source software and other licenses
Software, firmware, documentation, models, and other materials linked from the Site may be subject to separate license files or notices. Those licenses, not these Terms, govern your rights in the applicable materials.
A description of a project as “open source” does not grant rights beyond the license that accompanies a particular repository, release, or file. If material has no express license, no license is implied except the limited right necessary to view it through the Site.
You are responsible for reviewing and complying with all applicable licenses, attribution requirements, third-party notices, and patent terms.
7. Site content and intellectual property
Except for material governed by a separate license or owned by a third party, the Site and its content, selection, organization, branding, and design are owned by Wavey or its contributors and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and view the Site for the permitted purposes in Section 3. No trademark, patent, or other intellectual-property right is granted by implication or estoppel.
“Wavey” names, logos, and branding may not be used in a way that suggests sponsorship, endorsement, or affiliation without permission.
8. Feedback and contributions
If you submit feedback, suggestions, or ideas through the Site, you grant Wavey a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, and otherwise exploit that feedback for any lawful purpose without payment or attribution.
This feedback license does not apply to a code or documentation contribution submitted under a repository contribution process; the terms and licenses applicable to that repository govern such contributions.
Do not submit confidential information or material you lack the right to provide. Our handling of personal information is described in the Privacy Policy .
9. Third-party services and links
The Site may link to or interoperate with third-party services, including GitHub, GitLab, Discord, status services, research publications, analytics providers, and the Wavey Console. Third-party services are governed by their own terms and policies.
We do not control and do not endorse or assume responsibility for third-party content, availability, security, accuracy, or practices. You use third-party services at your own risk.
10. Changes, availability, and termination
We may add, change, suspend, or discontinue any part of the Site at any time. We do not promise that content will remain available, current, complete, or compatible with any particular hardware or software.
We may restrict or terminate access if we reasonably believe you have violated these Terms, created legal or security risk, or disrupted the Site. Provisions that by their nature should survive termination will survive, including provisions concerning ownership, feedback, disclaimers, liability, indemnity, and disputes.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
WAVEY AND ITS CONTRIBUTORS DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SITE OR ANY DESCRIBED TECHNOLOGY WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR YOUR PURPOSE. TECHNICAL CONTENT MAY CONTAIN ERRORS AND MAY NOT ACCOUNT FOR YOUR HARDWARE, ENVIRONMENT, JURISDICTION, OR RISK PROFILE.
The Site does not provide legal, medical, safety, engineering, or other professional advice. You should obtain advice from appropriately qualified professionals for your circumstances.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVEY, ITS MAINTAINERS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY; OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGE WAS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID, IF ANY, TO ACCESS THE SITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD 100.
These limitations apply regardless of the legal theory and do not limit liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, or other liability made non-excludable by applicable law. Your jurisdiction may provide rights or remedies that override part of this Section.
13. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Wavey and its maintainers and contributors from claims, liabilities, damages, judgments, losses, and reasonable costs arising out of or relating to:
- your unlawful or unauthorized use of the Site;
- your breach of these Terms;
- your infringement or violation of another person’s rights; or
- a sensing system or other product you build, operate, or deploy.
This Section does not apply to the extent a claim was caused by the indemnified party’s own unlawful conduct, and it does not apply where prohibited by consumer-protection law.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory rights you have under the law of your residence, courts of competent jurisdiction in India will have exclusive jurisdiction over disputes arising from or relating to the Site or these Terms.
Before filing a claim, you and Wavey agree to make a good-faith effort to resolve the dispute informally by providing written notice and allowing 30 days for a response. This requirement does not prevent either party from seeking urgent injunctive or protective relief.
15. Changes to these Terms
We may update these Terms to reflect changes in the Site, our practices, or law. We will post revised Terms here and update the effective date. Changes apply prospectively from the stated effective date. If required by law, we will provide additional notice or request agreement.
16. General
These Terms and any expressly incorporated policies are the entire agreement regarding the Site. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of responsibility for the Site.
Headings are for convenience only. The words “including” and “includes” mean “including without limitation.”
